Terms of Service & Privacy Policy for OPTX
Effective Date: February 6, 2026 (Updated to reflect integrations with third-party services and app launches)
Welcome to Online Photography Trades (DBA OPTX) ("OPTX," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications (available on Google Play Store and Apple App Store), and related services (collectively, the "Platform"), which connect clients seeking photography services ("Clients") with photographers who offer such services ("Photographers"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
OPTX is an online marketplace that facilitates connections and transactions between Clients and Photographers. We do not directly provide photography services. All services are rendered by independent Photographers, and OPTX acts solely as an intermediary.
You must be at least 16 years old to create an account or offer services on OPTX. By using OPTX, you represent that you have the legal capacity to enter into a binding agreement. Users under 18 must have parental or guardian consent where required by law.
Account Creation: Clients and Photographers must create accounts to transact. Browsing public listings does not require an account.
Accuracy: You agree to provide truthful, complete information and keep it current.
Security: You are responsible for safeguarding your login credentials.
Third-Party Authentication: We use third-party services like Google Sign-In for account creation and login. By using these, you agree to comply with their terms (e.g., Google's Terms of Service) and authorize us to access limited data (such as email and profile) for authentication purposes.
OPTX uses third-party payment processors (such as Stripe) to handle transactions securely. We also support integrations with Google Pay and Apple Pay. Clients pay a 5% service fee on each booking. Photographers pay a 10% commission on completed bookings.
By using payment features, you agree to the terms of our payment processors (e.g., Stripe's Services Agreement, Google's Payment Terms, Apple's Apple Pay Terms). We are not responsible for any issues arising from these third-party services.
Stripe may generate IRS Form 1099-K for Photographers meeting reporting thresholds. You are responsible for all taxes, reporting, and compliance. OPTX does not provide tax advice—consult a professional.
For mobile app users, in-app purchases are subject to the terms of the Google Play Store or Apple App Store.
Photographers retain ownership of their photographs and work but grant OPTX a non-exclusive, royalty-free license to display, promote, and use such content on the Platform. Clients receive a limited license to use delivered photographs as specified in the booking agreement.
You agree not to use the Platform for illegal activities, harassment, fraud, spam, or uploading content that violates laws or third-party rights. Photographers must provide original work and adhere to professional standards. Violations may result in account suspension or termination.
When using third-party integrations (e.g., Google Calendar, Twilio, Resend), you must comply with their acceptable use policies.
Reviews: Clients may leave reviews for Photographers after bookings. Reviews must be honest, based on actual experiences, and not defamatory, harassing, or false.
Disputes between Clients and Photographers should first be resolved directly. OPTX may mediate upon request but is not obligated. Unresolved disputes will be governed by Nevada law and resolved through binding arbitration in Nevada. You waive the right to class actions.
For disputes involving third-party services (e.g., Stripe or Google), refer to their respective dispute resolution processes.
These Terms are governed by the laws of the State of Nevada. Any legal action will be brought exclusively in the federal or state courts located in Clark County, Nevada.
We may suspend or terminate your account for violations of these Terms, with or without notice. Upon termination, access to the Platform ends, but obligations such as outstanding payments survive. You may terminate your account at any time by contacting us.
The Platform is provided "as is" without warranties of any kind. OPTX disclaims all liability for service quality, damages, or losses arising from use of the Platform or interactions between users. Our total liability is limited to the fees paid to us in the 12 months preceding the claim.
We are not liable for any issues with third-party services, including Google, Apple, Stripe, Twilio, or Resend, or with app stores.
Bookings may be canceled by Clients within 24 hours for a full refund. After that, refunds are at the Photographer's discretion, minus OPTX fees. Cancellations by Photographers without reasonable cause may result in penalties. All refunds are processed through our payment processor.
You agree to indemnify and hold OPTX harmless from any claims, losses, or damages arising from your use of the Platform, violations of these Terms, or your interactions with other users.
We may update these Terms at any time. We will notify you via email or the Platform. Continued use after changes constitutes acceptance.
OPTX is not liable for delays due to events beyond our control. We may assign these Terms without notice. If any provision is invalid, the remainder remains in effect.

This Privacy Policy describes how OPTX collects, uses, and protects your information when you use our website, mobile apps, and services.
We collect: account data (name, email, phone, password); transaction data; communications; optional data (location, notifications); automatically collected data (IP, device info, usage logs); third-party data from Google Sign-In, Google Calendar, Google Pay, Apple Pay, Stripe, Twilio, Resend; app-specific data; location data.
We do not sell or rent your personal data.
OPTX uses Google APIs including Google Sign-In, Google Calendar, and Google Pay. We access Google user data only with your explicit consent through OAuth scopes and in accordance with the Google API Services User Data Policy and Limited Use requirements.
We do not request or access any other Google user data.
We use this data exclusively to: authenticate and create your OPTX account; sync bookings with Google Calendar (if connected); enable checkout via Google Pay; provide a personalized experience. We do not use Google user data for advertising, user profiling, or unrelated purposes.
We do not sell, rent, or share Google user data with third parties for their own purposes. Data is shared only with vetted service providers (contractually obligated, delete when no longer needed) and legal authorities when required by law. All sharing complies with Google's Limited Use requirements.
Google user data is stored on secure, encrypted servers (AES-256 at rest, TLS 1.3 in transit). Access is limited to authorized personnel. We follow Google's security best practices and perform regular audits.
We retain Google user data only as long as your account is active and the data is needed. You may request deletion by: (1) Revoking OPTX's access in your Google Account settings; (2) Deleting your OPTX account; (3) Emailing legal@optx.photo. We will delete or anonymize within 30 days (or as soon as feasible), except where legally required to retain.
We use your information to operate and improve the Platform; facilitate payments and bookings; communicate with users; enforce Terms; respond to legal requests; analyze usage; sync with Google Calendar; process payments; send push notifications; provide location-based features.
We implement encryption, access controls, and follow third-party security guidelines. Account data retained up to 7 years post-termination for legal compliance.
You may access or correct your account information; request deletion; withdraw consent for optional permissions; revoke third-party integrations. Email us; we respond within 30 days. California residents have CCPA/CPRA rights—submit requests to legal@optx.photo.
We share data with Stripe, Google, Apple, Twilio, Resend, AWS, Cloudinary, Supabase, Vercel, and app stores under strict confidentiality. No sharing for marketing without consent.
Account/transaction data: while active + 7 years. Communications: 2 years. Third-party data: deleted upon revocation. Location data: duration of booking/matching.
We do not knowingly collect data from users under 16. If discovered, we delete it promptly (COPPA compliance).
Data may be transferred to U.S. servers. We use Standard Contractual Clauses. EEA/UK/Switzerland users have additional GDPR rights.
We may update this Policy; changes posted here with new effective date. Continued use constitutes acceptance.
